What does the court consider to determine child support payments?

Answer:

While the courts apply Child Support guidelines set forth under SC code Section 43-5-580, arguments can be made as to why such support should be reduced or made larger based on an individual's unique factors and circumstance, including, but not limited to:

  • The non-custodial parent's income is substantially less than the custodial parent
  • Added burden of consumer debt due to property distribution
  • Large families with more than six children
  • Extraordinary continuing medical and/or dental bills
  • Other child support payments for children of a previous marriage
