Child Custody & Support
Question:
What does the court consider to determine child support payments?
Answer:
While the courts apply Child Support guidelines set forth under SC code
Section 43-5-580, arguments can be made as to why such support should
be reduced or made larger based on an individual's unique factors and circumstance, including, but not limited to:
- The non-custodial parent's income is substantially less than the custodial parent
- Added burden of consumer debt due to property distribution
- Large families with more than six children
- Extraordinary continuing medical and/or dental bills
- Other child support payments for children of a previous marriage
Your attorney can better help you assess your situation and determine if special circumstances apply for the court's consideration.
