Question:
What if my spouse doesn’t play fair while details of the agreement are being discussed?
Answer:
Entering into a Collaborative Law Agreement requires, a) motivated good faith from both parties, and b) focus on the ultimate goal of a collaborative agreement that both parties can trust will be upheld.
During the Collaborative process, if either party withholds information, chooses to ignore preliminary agreements, or acts outside of the “good faith” required, there is no authority to force compliance.
If one or both parties cannot or will not fulfill their obligations to the process, the only option is withdraw from the Collaborative Law agreement, hire new attorneys and start over by filing directly within the Court system.
