Question:

What documents do I need to provide an attorney?

Answer:

When you have made the decision to file for divorce, or a divorce action has been filed by your spouse, it's a good idea to prepare a 3-ring binder with pockets so that you can begin gathering documents and keeping track of important information. Take this folder with you to your initial consultation with an attorney and to all subsequent visits, as you'll be adding to it and may need to provide items to your attorney as you go along.


It's worth noting that due to the high level of emotions that can, and do occur during divorce proceedings, items previously agreed to may suddenly be challenged; distribution of property, child custody and issues of financial responsibility. Keeping accurate records of discussions and your understanding of all agreements/promises, as well as failures to meet those agreements/promises may prove helpful in the future.

Standard documentation you should include (copies, not originals) are:

  • Personal data sheet on each family member, including children:
    • full name and current address
    • birth dates, age
    • Social Security number
    • special needs, medical/dental/mental health
    • date of separation and separation agreements, if any in writing
    • previous attempts to reconcile
    • marriage counseling provider
    • copy of any legal action pending against either party, including police reports in the case of domestic violence
    • Information (court documents) regarding any previous divorce decree
  • Financial
    • List of monthly bills (itemized)
    • Last year's tax return and any on-going communication from tax authorities (Fed or State)
    • Current income statement/pay stub (including year-to-date gross, tax info)
    • IRA or Retirement statement
    • Stock or other investment statements
    • A complete list of major assets; cars, boats, motor home, motor cycles, Time-Shares, etc, including copy of current registration/title.
    • Itemized outstanding debts (consumer credit, medical bills, etc)
    • Copy of current mortgage statement (if you own your home, including any second mortgages)
    • Life Insurance Policy -- Certificate of Coverage Page
    • Estimated value of household goods, itemized (including furniture, appliances, computer equipment, etc.
